INEC Opposes Court Bid to Deregister ADC


The Independent National Electoral Commission (INEC) has formally opposed an application seeking the deregistration of the African Democratic Congress (ADC).


The Incorporated Trustees of the National Forum of Former Legislators filed the suit at the Federal High Court in Abuja, praying for an order compelling INEC to deregister the opposition party, alongside others, over alleged failure to meet constitutional requirements. 


In court filings, INEC argued that the plaintiff’s application does not satisfy basic constitutional and legal requirements for deregistering a political party. 


The electoral body stressed that the deregistration of any registered political party is strictly governed by extant laws and constitutional provisions, and cannot be influenced by political pressure. 


The suit, which also targets parties such as the Accord Party, Zenith Labour Party (ZLP), and Action Alliance (AA) in related filings, comes amid ongoing leadership crises and internal wrangling within the ADC.


Recently, the Supreme Court directed key ADC figures, including factional national chairman Senator David Mark and Nafiu Bala, to return to the Federal High Court for the resolution of the party’s leadership dispute. 


Following developments in the crisis, the ADC has experienced a significant exodus of members, including the high-profile defection of former Labour Party presidential candidate Peter Obi and former Kano State Governor Rabiu Musa Kwankwaso to the newly prominent Nigeria Democratic Congress (NDC). 


The case highlights the intense political realignments and legal battles shaping Nigeria’s opposition landscape ahead of the 2027 general elections.
