Adeyemi is challenging his detention without trial and seeking bail pending the determination of the charges against him.
The matter came up on Thursday for the respondents to show cause why the remaining reliefs should not be granted.Counsel for Adeyemi, Muhammad Abdulaziz, told the court that the respondents had been served and that the applicant was ready to proceed.
However, counsel for the Attorney-General of the Federation and the other respondents were absent.The court registrar confirmed that the order was served on the respondents on September 8 and the hearing notice on September 9.
Justice Egwuatu noted that the 72-hour period earlier granted to the respondents to respond had not yet expired.
He also questioned whether the proof of service for the hearing notice had been properly sworn before a commissioner for oaths.
“Well, in any case, the 72 hours has not expired. And yesterday, you told me it will expire today and that was why I fixed today. You know the urgency of your matter, you are the one to do the needful,” the judge said.
He then returned the case file to the registry for reassignment, directing the applicant to return once the respondents’ time had expired and the matter was ready to proceed.
The development follows an earlier order directing the Inspector-General of Police, the Nigeria Police Force and the Attorney-General of the Federation to show cause within 72 hours.
The court had already granted one relief, allowing Adeyemi access to lawyers of his choice at reasonable hours while in custody.
Adeyemi is facing an eight-count charge of alleged forgery, fraud and impersonation over his claim to head the PFIPC, an organisation the Presidency has described as fake.
He was arrested in Osun State in July after a bench warrant was issued for his repeated failure to appear for arraignment. He is expected to be arraigned on September 30.
