The Federal High Court in Abuja has adjourned until September 28, 2026, a suit seeking to restrain former Senate President David Mark and other members of the African Democratic Congress (ADC) interim leadership from parading themselves as party executives.
The case, filed by party member Nafiu-Bala Gombe, was scheduled for hearing on Monday before Justice Peter Lifu but could not proceed as the judge did not sit.
The matter, marked FHC/ABJ/CS/1819/2025, will now be heard later this month.Justice Lifu had previously dismissed applications by the ADC and its National Secretary, Ogbeni Rauf Aregbesola, requesting his withdrawal from the case on grounds of alleged bias.
He ruled the applications lacked merit and awarded ₦1 million in costs against both the party and Aregbesola in favour of Gombe.
In the substantive suit, Gombe argues that the emergence of Mark, Aregbesola, and other members of the interim National Working Committee violates the ADC constitution and the Electoral Act.
He is asking the court to restrain them from acting as party leaders.
The defendants in the case include the ADC, David Mark, Rauf Aregbesola, the Independent National Electoral Commission (INEC), and former ADC National Chairman Ralph Nwosu.
