Justice Mohammed Garba Umar of the Federal High Court in Abuja has scheduled Friday, May 8, 2026, to deliver a ruling on the no-case submission filed by activist and politician Omoyele Sowore.
Sowore is facing a two-count cyberstalking charge filed by the Department of State Services (DSS) for allegedly calling President Bola Tinubu a “criminal” in posts on his X (formerly Twitter) and Facebook accounts.
The ruling date was fixed on Monday after Sowore’s counsel, Marshall Abubakar, and the DSS counsel, Mr. Akinlolu Kehinde, SAN, adopted their final written addresses on the no-case submission filed by the defence on April 21, 2026.
Abubakar argued that the prosecution failed to establish a prima facie case against his client, noting that Sowore was not properly linked to the alleged offences.
He urged the court to discharge and acquit Sowore, citing the failure of the prosecution to call vital witnesses.
In opposition, Kehinde contended that the DSS had presented sufficient evidence through its witnesses to require Sowore to enter his defence. He prayed the court to dismiss the no-case submission.
Sowore was re-arraigned on the amended charges on December 5, 2025. He pleaded not guilty to the counts, which allege that his posts were intended to cause a breakdown of law and order or pose a threat to life.
The matter has been adjourned to May 8, 2026, for the court’s ruling on whether Sowore has a case to answer.
