Appeal Court Restrains Gov Adeleke from Taking Action in Akirun Chieftaincy Dispute


The Court of Appeal sitting in Akure, Ondo State, on Monday issued a restraining order against Osun State Governor Ademola Adeleke, barring him and other parties from taking any further steps in the Akirun of Ikirun chieftaincy dispute until the appeal before the court is determined.


The appellate court directed all parties to maintain the status quo, with Oba Olalekan Akadiri remaining on the stool.


The ruling follows the Osun State Government’s earlier declaration of the stool as vacant and its directive contained in a government White Paper that all parties should await the outcome of the pending appeal before proceeding on the matter. 


The White Paper stemmed from reports by committees set up to review issues from executive orders signed by Governor Adeleke in November 2022.


Delivering the ruling, Justice S.O. Nwaka Gbagi emphasized the need to prevent a breakdown of peace and order in Ikirun.


Counsel to Oba Akadiri, N.O. Oke (SAN), had informed the court that the chairman of the kingmakers, Chief Kareem Adetoyese, allegedly wrote to the Gboleru Ruling House requesting the presentation of candidates for the stool a move said to contradict the state government’s directive to suspend all actions pending the appeal.


Lawyers representing the various parties, including the Gboleru Ruling House and the Osun State Attorney-General’s office, agreed that no further action should be taken until the matter is resolved. 


Counsel for the kingmakers, Chief Sola Ebiseni, also backed the call for maintaining the status quo in the interest of peace.


The court expressed displeasure over reports that some parties continued processing nominations despite the government’s directive and the pending appeal.
