David Mark Sues INEC to Restore His ADC Leadership


Senator David Mark, the factional national chairman of the African Democratic Congress (ADC), has approached the Federal High Court in Abuja seeking to overturn the Independent National Electoral Commission’s (INEC) decision to derecognise his leadership of the party.


In a motion filed on April 7, 2026, before Justice Emeka Nwite, Mark is demanding a mandatory injunction compelling INEC to immediately restore his name as national chairman and that of Rauf Aregbesola as national secretary on its official portal.  

  

INEC had on April 1, 2026, removed the names of Mark, Aregbesola, and other members of the party’s National Working Committee (NWC) from its records, citing a Court of Appeal judgment that directed parties to maintain the “status quo ante bellum.”  

  

Through his counsel, Sulaiman Usman (SAN), Mark argued that INEC misinterpreted the appeal court’s ruling. 


He maintained that the “status quo ante bellum” refers to the position as at September 2, 2025, when the original suit was filed, when his leadership was duly recognised.  

  

 The motion also seeks:

An order setting aside INEC’s refusal to monitor the ADC’s congresses and convention. 

An order restraining INEC from recognising any rival leadership or altering the party’s records until the substantive suit is determined. 

Accelerated hearing of the case on a day-to-day basis.

  

Mark’s team described INEC’s action as wrongful and one that has created uncertainty, affected the party’s internal administration, and undermined democratic participation.

  

 The case highlights the ongoing leadership crisis within the ADC, which has seen multiple factions contending for control of the party.
