The Federal High Court in Abuja has issued an order stopping the Independent National Electoral Commission (INEC) from recognizing state congresses conducted by committees set up by the David Mark-led caretaker leadership of the African Democratic Congress (ADC).
Justice Joyce Abdulmalik, in a ruling delivered on Wednesday, stated that the power to conduct state congresses lies with the party’s State Executive Committees, not the national caretaker body.
The court affirmed that the four-year tenure of the ADC’s State Working Committees and State Executive Committees remains valid and in effect until properly constituted congresses are held and a national convention is convened.
Justice Abdulmalik further held that neither the 1999 Constitution nor the ADC constitution grants the interim National Working Committee under David Mark the authority to appoint committees for the purpose of conducting state congresses.
The judgment was in suit no. FHC/ABJ/CS/581/2026, filed by Don Norman Obinna, Johnny Tovie Derek, Obah C. Ehigiator, Hon. Olona Yinka, Dr. Charles Idowu Omideji, Samuel Pam Gyang, and Obianyo Patrick.
The plaintiffs sued for themselves and on behalf of all State Chairmen and State Executive Committees of the ADC.
