Court Grants Malami, Son ₦200m Bail Each in Terrorism Financing Case


A Federal High Court in Abuja has granted bail to former Attorney-General of the Federation Abubakar Malami (SAN) and his son Abdulaziz Malami, each in the sum of ₦200 million, over alleged terrorism-related offences.


Presiding Judge Joyce Abdulmalik delivered the ruling on Friday, February 27, 2026, following a formal bail application after the pair's arraignment earlier in the month.


The court stipulated stringent conditions:

Each defendant must provide two sureties in like sum (₦200 million each). 

One of the sureties for each must submit the title deed of a developed property located in the highbrow Asokoro or Maitama districts of Abuja. 

Both defendants are required to deposit their international passports with the court registry.

 

Malami and his son were arraigned on February 3, 2026, before the same judge on a five-count charge bordering on abetting terrorism financing and unlawful possession of firearms. 


They pleaded not guilty to all counts.Prosecutors, led by the Department of State Services (DSS), allege that Malami, while serving as AGF in November 2022, knowingly abetted terrorism financing by refusing to prosecute suspected terrorism financiers whose case files were forwarded to his office for action. 


The charges invoke Section 26(2) of the Terrorism (Prevention and Prohibition) Act, 2022, among others.


This case is separate from but follows closely on the heels of an ongoing money laundering prosecution by the Economic and Financial Crimes Commission (EFCC) against Malami, his wife Asabe Bashir, and son Abdulaziz, involving allegations of laundering billions of naira. 


Malami had previously secured bail in that matter before being re-arrested in connection with the terrorism allegations.


The defendants had been remanded in DSS custody pending the bail hearing, with earlier oral bail applications rejected in favor of formal motions.


The ruling allows the former AGF and his son to regain temporary freedom pending trial, subject to perfecting the bail terms. 


The case has been adjourned for further proceedings, with the court emphasizing compliance to ensure the defendants do not jump bail.


The development adds to the mounting legal challenges facing the former top government official since leaving office, highlighting intensified anti-corruption and security-related scrutiny in Nigeria.
