Justice Joyce Abdulmalik, on January 23, 2026, adjourned the case indefinitely to February 20, 2026, after defense counsel Chris Uche (SAN) argued that the entry of an appeal deprives the lower court of jurisdiction to continue hearing the matter.
The suit, filed by a faction aligned with FCT Minister Nyesom Wike, includes acting National Chairman Mohammed Abdulrahman and factional National Secretary Senator Samuel Anyanwu.
They seek an injunction to restrain the Tanimu Kabiru Turaki-led camp (defendants 5th to 25th) from parading themselves as PDP representatives.
During the resumed hearing, the defense withdrew an earlier application for a stay of proceedings, which the plaintiffs did not oppose, leading the judge to strike it out. Uche then urged an indefinite adjournment, citing the transferred jurisdiction following the appeal's entry.
Plaintiffs' counsel Onyeachi Ikpeazu (SAN) objected to an indefinite adjournment, noting the lack of supporting affidavit, but the judge partially agreed with the defense's jurisdictional argument, referencing legal precedents.
This development stems from prior ex-parte orders by the court, which the Turaki faction appealed, escalating the dispute to the appellate level.
The PDP has been grappling with factional divisions, including disputes over national leadership positions and the legitimacy of party conventions, with rival groups claiming authority amid preparations for future elections.
The pause allows the Court of Appeal to first resolve the related appeal, potentially shaping the path forward for the high-stakes tussle.
