NBA Sues Nigeria Police Over Tinted Glass Permit Policy, Cites Rights Violations


The Nigerian Bar Association (NBA) has filed a lawsuit against the Nigeria Police Force challenging the controversial tinted glass permit policy introduced by the Inspector-General of Police in April 2025. 


The policy, which requires motorists to obtain annual permits for tinted vehicle glasses through the digital portal possap.gov.ng, has sparked widespread criticism. 


The NBA, during its National Executive Council (NEC) meeting in Enugu on August 23, 2025, resolved to contest the policy’s legality, arguing it infringes on citizens’ constitutional rights to dignity, privacy, freedom of movement, and property under the 1999 Constitution.


The association questions the policy’s legal basis, which relies on the 1991 Motor Tinted Glass (Prohibition) Act, a military decree that may not align with democratic standards. 


Additional concerns involve the policy’s financial structure, as permit fees are reportedly paid into a private account managed by Parkway Projects, rather than the Federation Account or Treasury Single Account, raising transparency issues.


The NBA, through its Section on Public Interest and Development Law (SPIDEL), initiated the suit (FHC/ABJ/CS/182/2025) at the Federal High Court in Abuja on September 2, 2025, naming the Inspector-General of Police as the defendant. 


Despite the policy’s enforcement being deferred from June 1 to October 2, 2025, reports of police harassment and extortion of motorists persist.


 Prof. Paul Ananaba, SAN, Chairman of NBA-SPIDEL, confirmed the litigation and called for the police to halt enforcement pending the court’s ruling. The case awaits assignment to a judge.
