Gail Fajembola, a Lagos socialite, has filed a fundamental rights enforcement suit at the Federal High Court in Lagos. She seeks an order of perpetual injunction to restrain Olutoy Estate Development & Services Ltd, the Inspector General of Police (IGP), and four others from arresting, detaining, or harassing her over a property dispute.
The dispute centers around Flat K9-2, Ocean Parade Towers, Banana Island, Ikoyi, which Fajembola claims she was permitted to occupy by Tunde Ayeni in 2016.
Fajembola alleges that the police are being used to intimidate her into evicting a lawful tenant and surrendering possession of the property to Olutoy Estate Development & Services Ltd. Fajembola is seeking several declarations, including that any threats by the police to arrest or detain her over a private civil dispute are unconstitutional and a violation of her rights to dignity, liberty, and freedom of movement.
The suit was filed under the Fundamental Rights (Enforcement Procedure) Rules, 2009, and Sections 35(1), 36, 41(1), and 46(1) of the 1999 Constitution (as amended).
The respondents include the IGP, Assistant Inspector General of Police (Zone 2), Commissioner of Police (Lagos State Command), Ogbonna Nweke, and Tunde Ayeni.
Fajembola is seeking N50 million in damages for unlawful and unconstitutional interference with her constitutionally guaranteed freedoms.
Fajembola claims that her relationship with Tunde Ayeni was previously cordial, but deteriorated, leading to pressure to evict the tenant and return the apartment. She alleges that Ayeni and Olutoy Estate Development resorted to police intervention to pressure her into vacating the property, rather than pursuing lawful eviction proceedings.
