Court stunned, As a 13-year-old Girl Defends Lover over alleged rape

A 22-year old man, Peter Victor has been arrested by the police and charged before a magistrate’s in Lagos, southwest Nigeria, for allegedly raping a 13-year old girl (name withheld)

He is now facing a charge of rape before the Magistrate, Mrs M B Folami.

The victim stunned the police and the court when she said she was not raped by Victor as claimed by the police.

She said she allowed Victor to sleep with her thrice because she loved him and because he has been assisting her family.

She revealed that Victor has been buying gifts for her and members of her family, adding that she usually takes the gifts home to show her parents who sometimes share from them.

She also revealed that when Victor was arrested and she was brought to the station, she told the police that she was not raped, but she was asked to shut up because she was a minor.

It was gathered that the girl’s father was aware of the relationship between Victor and her daughter when she returned late in their last outing one day and during questioning, the girl told her father that she went out with the man.

On further inquiry, she was said to have admitted to her father that Victor had been sleeping with her.
The angry father was said to have gone to the police to report that Victor raped his daughter. Victor was, therefore, arrested and charged to court on a one-count charge of having unlawful canal knowledge of the girl.

The Cross River State-born admitted having sex with the girl, but that he did not rape her as claimed by the police.

He also told the court that she is her girlfriend and that he has being assisting her and her family.
The police insisted that it was a case of rape and charged him under section 137 of the Criminal Code Law of Lagos State of Nigeria. He pleaded not guilty.
He was denied bail and ordered remanded in Kirikiri prison.

  7. I just can't believe the comments here. A 22yr old man sleeps with a 13yr old girl and we say it's not rape???? What kind of a people have we turned into?
Don't we understand that at 13 this man deceived this girl into allowing him to sleep with her by buying gifts for her and her family?
Even if the family accepted the gifts, does that give him the right to rape the girl, yes I call it rape becos the girl in question is a MINOR!!! and she does not know any better!!!
What does the law say here?
In one of very few occassions the police get things right and we think they are wrong? Can you imagine this piece being read by a foreigner and what they will think of us? At the moment I am really ashamed to be a Nigerian. Kai!!!!

    1. Whether she is 13 or 30, you still have to buy gifts for them to have your way in so gift buying does not establish rape. What establishes rape is forcefull entry and the girl has denied any kind of forceful entry so there is no rape case. What we should be looking at is law against sleeping with a minor. But again what if two minors ave sex?h

  9. It is an offence under the criminal code to have sex with a girl under the age of 16 with or without her consent. The offence is called rape. Simple. The girl at 13 could not have known the nature of the act or the consequences. At worst she could not have given an informs consent.

  10. Victor did bad. He simply took advantage of a MINOR. He has messed up the life of a 13 year old, who knows little or nothing about Love and Sex.She started too early, pray she'll be able to cope with her emotions and urges there after!

  13. Anonymous @December 1 2012; 3:48PM and 6:27PM You should be ashamed of yourselves. In other countries of the world, you would have been traced, arrested and investigated for paedophilia..child molestation...How can you give such crude definitions to this situation? If the girl in question was your sister or daughter you will say the same thing???? Hmmn I guess so and that is why we are where we are at the moment in this country.
My people, we need to look inwards and change our ways, we cannot allow these things to continue like this, yes they do happen, but should we condone it with words like "Only God can control SEX in the world"???
God has told us what to do about situations like this in his words, let us just follow his instructions period!

  16. I just want to thank the contributors who have condemned this terrible thing.

Indeed, it is known as STATUTORY RAPE. The carnal knowledge of a minor below age 16, whether with or wit out her consent!

The minimum jail sentence is 7 years, I believe. Just imagine if it was your daughter? Yes, your daughter. What would you say then? That it was okay since the girl consented?

We should be ashamed of ourselves for making silly, unintelligible, comments when serious issues are being discussed.

Again, many thanks for those sensible comments.

As for the Daddy who was collecting presents from a young girl of 13 that were given to her by a 22 year old man, SHAME! SAME! SHAME!

This is the result. You let your 13 year old go out with a 22 year old man with blood running through his veins, and you collect gifts from him? On what basis, were the outings structured? On what basis was the relationship? Let us take care not to sell our children's innocence due to conditions we find ourselves.

God help us and May god bless NAIJA!

    PROUD NAIJA!
