Alleged Phone-Tapping: Court Rejects El-Rufai’s No-case Submission

A Federal High Court in Abuja on Monday rejected a no-case submission by former Kaduna State Governor Nasir El-Rufai in his trial over claims that he unlawfully intercepted the telephone communications of National Security Adviser Nuhu Ribadu.

Justice Joyce Abdulmalik ruled that the Department of State Services (DSS) had presented enough evidence to require the former governor to open his defence if he chooses. The judge ordered El-Rufai, the only defendant in the case, to proceed with his defence.

The DSS had closed its case after calling two witnesses. El-Rufai then filed the no-case submission through his lawyer, Akinyemi Aremu, arguing that the prosecution had not established a sufficient case for him to answer.

In response, DSS counsel Oluwole Aladedoye, SAN, adopted a counter-affidavit opposing the application. He argued that the defence had not addressed Exhibit “B,” which the prosecution said contained El-Rufai’s alleged admission about tapping Ribadu’s phone.

Aladedoye maintained that a prima facie case had been made out, so the law required the defendant to enter a defence. The News Agency of Nigeria (NAN) reported the development.
