Former Imo State Governor and current Senator representing Imo West, Rochas Okorocha, has filed a suit against the Independent National Electoral Commission (INEC), the All Progressives Congress (APC), and Governor Hope Uzodinma over the publication of Uzodinma’s name as the APC candidate for the 2027 Imo West senatorial election.
Okorocha, through his lawyer O.J. Aboje, filed the case on August 13, 2026, at the Federal High Court in Abuja.
The suit, marked FHC/ABJ/CS/1854/2026, challenges INEC’s decision to list Uzodinma as the party’s candidate despite Okorocha’s claim that he won the APC primary held on May 18.
The former governor is seeking ten reliefs, including a declaration that INEC’s publication of Uzodinma’s name was unconstitutional.
He argues that Uzodinma, still serving as governor, is ineligible under Section 183 of the 1999 Constitution (as amended) to contest for the Senate while in office.
Okorocha also wants the court to set aside Uzodinma’s nomination, recognise him as the duly elected candidate, and restrain Uzodinma from presenting himself as the APC nominee.
In an affidavit supporting the suit, Amen Rochas, Okorocha’s son and political aide, stated that the direct primary produced Okorocha as winner with 150,780 votes, while Uzodinma scored 102,158.
He further noted that Uzodinma’s tenure as governor runs until January 14, 2028, overlapping with the inauguration of the 2027 Senate.
The case is now before the Federal High Court for determination.
