An aspirant of the African Democratic Congress (ADC) for the Rivers State House of Assembly, Khana Constituency I, has sued his party, alleging unlawful exclusion from the primary election.
Legborsi Nwiabu filed the suit at the Federal High Court in Port Harcourt, naming the ADC, its declared candidate Bright Nulee, and the Independent National Electoral Commission (INEC) as respondents.
The matter came up for hearing on Friday. Counsel to the ADC, Emenike Ebete, informed the court that a committee had been constituted to resolve disputes arising from the primary and sought leave for an out-of-court settlement.
While counsel to the other respondents did not oppose the request, counsel to Nwiabu, Felix Beragbara, opposed it, stating that his client was not informed of any such committee.
Justice Muhammed Turaki granted the parties leave to explore settlement and adjourned the case to August 12, 2026, for a report on the outcome or for the hearing to proceed.
Speaking to journalists after the proceedings, Beragbara detailed the events leading to the lawsuit.
He said the ADC primaries were originally scheduled for May 21, 2026, but were purportedly shifted to May 22.
“My client mobilised his supporters and deployed agents to all voting centres across the 11 wards in Khana Constituency I.
They waited from morning till night, but no ADC official or INEC monitoring officer appeared to conduct the election,” he said.
Nwiabu subsequently petitioned the party’s appeals committee, demanding that a fresh primary be conducted.
According to his counsel, the party ignored the petition and declared Bright Nulee as the candidate, forwarding his name to INEC.
Beragbara stated that his client was in court to challenge the validity of the process that produced the candidate.
He added that Nwiabu remains open to settlement but is prepared to return to court if justice is not served.
