The federal government has opened its case against Chidiebere Mark, the social media influencer, popularly known as “Justice Crack”, by calling its first witness.
Mark was initially arraigned by the Department of State
Services (DSS) on May 4 on a three-count charge.
On May 18, the court granted him bail in the sum of N5
million with additional conditions attached.
The office of the directorate of public prosecutions (DPP)
later took over the prosecution of the case on May 14.
At the resumed proceedings on Monday before Joyce
Abdulmalik, the presiding judge, the defendant was re-arraigned on an amended
three-count charge.
However, he pleaded not guilty to the charges.
Counsel to the defendant urged the court to allow his client
to continue enjoying the earlier bail conditions already granted.
There was no opposition to the application, and the court
granted the request.
Following the re-arraignment, the prosecution called its
first witness, Oronto Douglas.
Led in evidence by the prosecution, Douglas told the court
that audio and video recordings of the defendant’s interview were extracted and
stored in a flash drive during the course of the investigation.
The witness also informed the court that he signed a
certificate of compliance in respect of the electronic evidence tendered before
the court.
The judge thereafter adjourned the matter until September 28
for continuation of the hearing.
The judge also noted that the prosecution counsel, who had
earlier applied to the deputy chief registrar, would make a further application
to the head of the court’s information technology department for the viewing of
forensic evidence in the case.
