An aspirant for Esan South East Constituency in the Edo State House of Assembly, Barrister Victor Giwa, has filed a suit at the Federal High Court Abuja to nullify the All Progressives Congress, APC, primary result for the seat.
In suit ABJ/FHC/C’S/1078/26 filed May 29, Giwa is asking the court to restrain Chief Sunday Oseizua Ojiezele from parading himself as APC’s candidate for the 2027 election. APC and INEC were joined as 2nd and 3rd respondents.
Giwa, represented by Patrick Ocheja Okolo, SAN, alleged the primary was marred by irregularities. He said no primary or consensus process was held on the election date at ward and LGA levels, but figures were “allocated” to Ojiezele who was then declared consensus candidate.
The aspirant claims he won votes in Wards 3, 4, 8, 9 and 10 but was allocated zero votes, while Ojiezele “did not emerge from any primary conducted nor consensus arrangement”.
Giwa is seeking interim orders to stop Ojiezele from being recognized as APC candidate and to stop INEC from accepting or publishing his name, pending the determination of the substantive suit. He also asked the court to order all parties to maintain status quo as at May 19, 2026.
No date has been fixed for hearing.
