A lawyer representing the African Democratic Congress (ADC) has told a court that the Independent National Electoral Commission (INEC) confirmed the election of David Mark and Rauf Aregbesola as the party’s national chairman and national secretary, respectively, at a meeting held on July 29, 2025.
Speaking to journalists after a court session in a video circulating on X, the counsel said INEC’s position supports the party’s claim that the National Executive Committee (NEC) meeting took place on that date and produced the current leadership.
“INEC agrees with us that the party held a NEC meeting on July 29, 2025, during which Senator David Mark and Ogbeni Rauf Aregbesola were elected as national chairman and national secretary of the ADC,” he said.
The lawyer added that INEC not only acknowledged the meeting but also confirmed its participation and documented it in an official report submitted as evidence before the court.
“They confirmed they attended the NEC meeting and that it produced the current leadership. They also attached their report to the court filings,” he said.
He dismissed the plaintiff’s claims as speculative and unsupported by evidence, noting that the opposing party alleged that the leaders emerged on July 22, 2025, without providing documentation.
“They have no proof for their claim. In contrast, we have documents showing that on July 4, 2025, the party notified INEC of the NEC meeting scheduled for July 29, which INEC attended and reported on,” he said.
The counsel maintained that the evidence clearly supports the party’s position, adding that the plaintiff lacks the legal standing to institute the case.
“What is the locus of the plaintiff? He is not an official of the party but merely a member,” he argued.
Citing Supreme Court precedents, the lawyer said individuals cannot institute legal actions on matters relating to the internal affairs of political parties.
“The Supreme Court is clear that issues concerning the internal affairs of a political party are not justiciable by individuals, and courts lack jurisdiction to entertain such matters,” he added.
