ADC Accuses FG of Selective Justice in Malami, El-Rufai Cases


The African Democratic Congress (ADC) has accused the Federal Government of applying justice selectively in the ongoing legal proceedings against two of its prominent members: former Attorney General of the Federation and Minister of Justice, Abubakar Malami (SAN), and former Kaduna State Governor, Mallam Nasir El-Rufai.


In a statement issued by its National Publicity Secretary, Mallam Bolaji Abdullahi, on March 3, 2026, the party emphasized that while no citizen is above the law, justice must be administered evenly, transparently, and free from political bias in a constitutional democracy.


The ADC highlighted concerns over the handling of the cases, noting prolonged custodial movements, rapid inter-agency transfers, and processes that appear to precede fully crystallized prosecutions for Malami and El-Rufai. 


The party contrasted this with another high-profile case involving allegations of passport forgery, international conspiracy, impersonation, and related claims, where the accused were swiftly granted bail and proceedings advanced promptly.


"When a citizen is transferred from one detention facility to another before investigations are demonstrably concluded, it inevitably begs the question: is detention being used as an investigative shortcut, or as an instrument of pressure to keep these opposition leaders out of circulation?" the statement read.


The ADC reaffirmed the presumption of innocence for Malami and El-Rufai, stating they are citizens first and entitled to full constitutional protections until proven guilty in a fair court. 


The party pledged to stand by its members, insisting that supporting them is not obstructing justice but demanding that it be done properly and impartially.


The opposition party called for immediate public clarification from relevant authorities on the status of the investigations, strict adherence to safeguards against arbitrary or prolonged detention, transparent and time-bound prosecution of any credible charges, and equal application of the law regardless of political alignment.


The statement comes amid ongoing scrutiny of the cases, with Malami facing charges related to alleged money laundering involving N8.7 billion, alongside family members, while El-Rufai's matters reportedly involve issues such as phone interception and other allegations. 


The ADC described the actions as raising serious public concerns about consistency and fairness in law enforcement.
