A Federal High Court in Abuja has sent the fundamental human rights enforcement suit filed by former Kaduna State Governor Nasir El-Rufai to the Chief Judge of the Federal Capital Territory (FCT) for reassignment to another judge.
The transfer followed Justice Inyang Ekwo’s announcement in open court that he would be proceeding on leave, making it necessary to return the file for fresh allocation.
The matter had been adjourned from Wednesday, February 25, to Thursday, February 26, specifically for hearing of El-Rufai’s bail application.
In the suit, El-Rufai is seeking enforcement of his fundamental rights and relief from alleged harassment and unlawful actions by:
Independent Corrupt Practices and Other Related Offences Commission (ICPC)
Economic and Financial Crimes Commission (EFCC)
Department of State Services (DSS)
Attorney-General of the Federation
El-Rufai has been in custody since February 16, 2026, when he voluntarily reported to the EFCC.
He was later moved to ICPC custody on February 18.The update was confirmed in a statement by his media adviser, Muyiwa Adekeye.
His continued detention without formal charges in open court has drawn sharp criticism. On Wednesday, Muslim Rights Concern (MURIC) Director Prof. Ishaq Akintola urged the agencies to either charge him or release him unconditionally.
A separate DSS criminal case against El-Rufai was stalled earlier this week after the agency failed to produce him in court, citing that he remained in ICPC custody.
That matter was adjourned to April 23, 2026.MURIC described the situation as appearing to reflect a deliberate effort to prolong custody.
The case is now expected to proceed more swiftly once reassigned by the FCT Chief Judge, with the bail application and core claims of rights violations likely to be addressed early under the new judge.
