AGF Orders NIS to Reinstate Sacked Officer


The Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN), has directed the Comptroller-General of the Nigerian Immigration Service (NIS), Mrs. Kemi Nanna-Nandap, to reinstate a dismissed officer, Daniel Makolo, in compliance with a subsisting 2023 court judgment.


In a letter dated September 18, 2025, the AGF responded to a request for legal guidance from the NIS Comptroller-General and advised strict adherence to the ruling of the National Industrial Court of Nigeria (NICN). 


The court, in its January 24, 2023 judgment (Suit No: NICN/ABJ/337/2020), voided Makolo's dismissal as unlawful citing procedural flaws such as disciplinary proceedings exceeding the 60-day limit under Public Service Rules, lack of a formal query, and improper investigation and ordered his reinstatement without loss of rank, position, or privileges.


The AGF emphasized that the judgment was not appealed and remains valid, subsisting, and enforceable. 


He warned that failure to comply could expose the relevant authorities to contempt proceedings and other legal consequences.


Makolo's dismissal occurred over 15 years ago, but a 2017 clearance letter following intervention by the Office of the National Security Adviser failed to fully restore his rank and entitlements. 


Despite this and other interventions by senior federal agencies, compliance has been lacking, prompting Makolo to file a motion on January 14, 2026, seeking enforcement, payment of outstanding salaries, allowances, and emoluments from November 2017 onward, plus medical support.


The defendants in the case include the Minister of Interior, Olubunmi Tunji-Ojo; the Secretary of the Civil Defence, Correctional, Fire and Immigration Services Board, Maj Gen Abdulmalik Jibrin; NIS Comptroller-General Nanna-Nandap; Head of Service of the Federation, Mrs. Didi Walson-Jack; and the AGF himself.


Makolo has described the non-compliance as deliberate and contemptuous, accusing the authorities of ignoring multiple directives from high-level government offices.
