Activist lawyer, Deji Adeyanju, has charged former governor of Kaduna State, Nasir El-Rufai to stop what he termed “acting movies” and challenge the seizure of his international passport in court.
Adeyanju said El-Rufai should declare in court that the security agencies have no legal right to seize his international passport.
Featuring on AIT’s programme, Security Scope, Adeyanju insisted that the Department of State Services, DSS, has the right to seize El-Rufai’s passport on certain conditions.
He said: “Yes, DSS has the right to size El-Rufai’s passport under the law, section 2 of the DSS instrument which is pursuant to the NSA act gives them the power.
“When somebody is on the wanted list, immediately you are declared wanted and your name is on that list, the security agencies at point of entry or exit may seize your passport.
“However, that violates the right of ingress and negress of every citizen; interestingly this similar thing happened with Olisa Agbakoba, he sued the DSS and he won in that matter.
“El-Rufai is aggrieved, the best thing to do is not to act movies and make noise, it’s to go to court and challenge that there was no legal basis for the seizure of his passport.
“There are two ways where the passport of a citizen can be seized, where the right of ingress and negress can be denied of a citizen.
“If the court say so, for instance if a person is standing trial for an alleged offence, the court can say one of the condition for bail is to deposit your international passport at the registry of the court, which may likely be the outcome of El-Rufai’s passport.
“The second instance is when the person is on a watchlist, if EFCC declared you wanted.”
