Police suspend enforcement of tinted glass permit policy over court order

The Nigeria Police Force (NPF) has suspended the enforcement of the tinted glass permit policy in compliance with a court order.

The enforcement of the policy was scheduled to commence on January 2, 2026.

However, Benjamin Hundeyin, the force spokesperson, said in a statement on Thursday that the policy has been suspended pending the hearing and determination of the substantive suit or the vacation of the order.

BACKGROUND

In December 2025, the Delta state high court issued an ex parte injunction restraining the NPF from commencing the enforcement of the tinted glass permit policy nationwide.

The suit was filed by Israel Joe against the inspector-general of police (first defendant), the NPF (second defendant), and the Delta police commissioner (third defendant).

The Nigerian Bar Association (NBA) and the police have been at loggerheads over the enforcement of the policy.

On December 15, 2024, police announced that enforcement of the tinted glass permit policy would resume on January 2, 2026, citing a surge in vehicle-related crimes.

Responding to the development, the NBA accused the police of flouting a court order restraining the enforcement of the policy.

The NBA said the police announcement “amounts to executive recklessness” and portrayed the police leadership as “lacking in respect for the court, the rule of law, and due process of law”.

Reacting to the NBA, the police said there was no court order declaring the policy unlawful or permanently restraining the police from carrying out their statutory responsibilities.

‘POLICE WILL UPHOLD RULE OF LAW’

Hundeyin said the police had been served with the interim court order restraining it from enforcing the policy.

The force spokesperson disclosed that the police had entered an appearance in the case and applied for the vacation of the order.

He said the case has been adjourned to January 20 for further proceedings.

“In line with constitutional obligations and respect for judicial authority, the Nigeria Police Force has entered an appearance in the matter, raised preliminary objections, and formally applied for the vacation of the interim order,” the statement reads.

“The court has adjourned the case to 20th January 2026 for further proceedings.

“Accordingly, and strictly in compliance with the subsisting court order, the Nigeria Police Force has placed the enforcement of the Tinted Glass Permit policy on hold nationwide, pending the decision of the court.

“The Inspector-General of Police, IGP Kayode Adeolu Egbetokun, PhD, NPM, affirms that the Nigeria Police Force remains resolute in upholding the rule of law while discharging its primary mandate of protecting lives and property.

“The Force will continue to deploy lawful, intelligence-driven strategies to address security challenges and safeguard public safety across the country.”
