Dangote Refinery Withdraws ₦100bn Suit Against NMDPRA, NNPC

Dangote Petroleum Refinery has withdrawn its N100 billion suit challenging the issuance of licences for importation of petroleum products into Nigeria.

On September 6, 2024, Dangote refinery filed a suit against the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA) (first defendants), the Nigerian National Petroleum Company (NNPC) Limited (second defendant) and five others.

Other defendants are AYM Shafa Limited, A. A. Rano Limited, T. Time Petroleum Limited, 2015 Petroleum Limited, and Matrix Petroleum Services Limited.

Dangote refinery asked the court to rule that the NMDPRA violated sections 317 (8) and (9) of the Petroleum Industry Act (PIA) by granting licences for petroleum product importation, adding that such licences should only be issued in circumstances where there is a petroleum product shortfall.

At the resumed sitting on Wednesday, the plaintiff, through its lawyer, C. O. Adegbe, informed the court that it filed the notice for the discontinuation of the suit on July 28, after agreeing with the defendants that the matter should be struck out.

In response, Mohammed Umar, the presiding judge, dismissed the suit after listening to the submission from Adegbe and lawyers of the defendants.
