Court sets July 2 to rule on Mohbad's father's bid to reopen case against Naira Marley, Sam Lerry

 


The Lagos State High Court in Ikeja has scheduled July 2, 2025, to deliver its ruling on an application filed by Joseph Aloba, father of late singer Ilerioluwa Aloba (Mohbad), seeking to challenge the legal advice that cleared music promoter Sam Larry and artist Naira Marley of any involvement in his son’s death.



Justice Taiwo Olatokun fixed the date after hearing submissions from senior lawyer Wahab Shittu (SAN), representing Mr. Aloba, and Joke Amachree, counsel for the Lagos State Attorney General and the Director of Public Prosecutions (DPP), who are named as respondents in the case.



Mr. Aloba, representing the interests of the Aloba family, argued that the DPP’s decision to discharge the suspects was made without due process and violated the principle of fair hearing. He also claimed the decision was premature and interfered with the ongoing Coroner’s Inquest still investigating the cause of Mohbad’s de@th.



Shittu emphasized that the DPP acted without waiting for the inquest to conclude, discharging individuals who had been mentioned and implicated during proceedings.



In response, a counter affidavit filed by Ayinde Ibrahim from the DPP’s office insisted that the suspects were not acquitted but only discharged due to lack of sufficient evidence at the time. He added that the DPP’s decision followed a legal review of the case file submitted by the police.
