Man bags 16 years imprisonment for rape, indecent assault



An Ado-Ekiti High court, on Wednesday, sentenced a 40-year-old man, Oladipupo OluwaSeun to 16 years imprisonment for an attempt to commit rape and indecent assault.


The defendant was arraigned on February 19, 2021, at Igede-Ekiti, in Irepodun/ Ifelodun Local Government Area of Ekiti State, for an attempt to rape an 18- year-old girl.


In his judgment, Justice Adekunle Adeleye said, “by the preparation made by the defendant, he assaulted Mariam intentionally, I have no doubt in my mind that it was the defendant and no other person that assaulted Mariam at a period after midnight of 18th February 2021.


“Adeleye said the prosecution has proved beyond reasonable doubt that the defendant assaulted Mariam indecently, he is found guilty as charged in count one attempt to rape and count two indecent assault.


“The defendant is hereby convicted as charged in counts one and two contrary to the provisions of 359 and 360 of the Criminal Code, Cap. C16 Laws of Ekiti State, 2012.


“In Count 1, the defendant is hereby sentenced to 14 years imprisonment, Count 2, the defendant is hereby sentenced to 2 years imprisonment,” Adeleye ruled.


In her statement, “the victim alleged that the defendant came to her home around 11:00pm without inviting him, though, he once asked me out but I refused.


“When he entered our room he covered my mouth with cloth and forcefully have sexual intercourse with me, I know him as Samora but I got to know his real name as Oladipupo Oluwaseun at Igede Police Station when he was arrested after I reported the incident at the Police station”, she said.


The convict in his defence through his counsel, Miss Helen Akinboni, denied the allegation of rape, saying, “the victim is my girlfriend, we are only romancing in the room when her father came in, I ran away because I was afraid of her father, who came to arrest me on the second day.


To prove his case, the prosecutor, Folasade Alli called two witnesses and tendered the convict and victim statements including a medical report as an exhibit.


The prosecutor said the offence contravened Sections 359 and 360 of the Criminal Code Law, Cap C16, Laws of Ekiti State, 2012.
