Court orders extension of injunction order in Sunday Igboho’s case


An Oyo State High Court hearing the fundamental rights suit filed by Sunday Igboho on Tuesday ordered the extension of the injunction order restraining the Attorney General of the Federation and Minister of Justice, the DSS, their agents or privies from arresting Sunday Igboho till September 17.

Our correspondent learnt that Sunday Igboho is at the forefront of the agitation for the establishment of the Yoruba nation.

Igboho had earlier filed a suit in the court asking the court to ensure enforcement of his fundamental human rights.

Our correspondent reports that the court under the leadership of Justice Oladiran Akintola on Tuesday ordered the extension of the injunction order.

The judge in his ruling also adjourned the judgement of the suit till September 17.

Akintola while adjourning the judgement also ordered the extension of the injunction order restraining the AGF, DSS from arresting Igboho till September 17.

Counsel to the AGF, Abdulahi Abubakar stressed that the court should set aside the August 4 injunction restraining the first defendant, the attorney general of the Federation, Abubakar Mallami.

Abubakar urged the court to disregard the counter-affidavit and written address as well as setting aside the subsequent extension of the interim injunction order filed by the applicant.

But, counsel to Igboho, Yomi Alliyu in his submission said he filed a counter-affidavit and written address on 24th August 2021, and that he is adopting and relying on the written counter affidavit.

Alliyu argued that the application filed by Counsel to the AGF was not properly filed before the court as it was brought outside the 7 days stipulated by order 4 rule 6 of the fundamental human rights procedure rule 2009.

He said their reply on point of law is an admission that they are not within time, adding that as at present, there was no motion for the extension of time from them, saying, the Court was not a Father Christmas and that the oral application cannot replace the process mandated by rules of Court.

Akintola after listening to all the parties involved then extended the Interim order restraining the Attorney General of the Federation, DSS, their agents or privies till the next date of adjournment.
