APC chieftain sues NASS over election re-ordering

A chieftain of the All Progressives Congress, APC, Chief Anike Nwoga, has filed a suit challenging the bill passed by the National Assembly, NASS, changing the sequence of the 2019 elections as proposed by the Independent National Electoral Commission, INEC.


Nwoga’s Counsel,Godwin Onwusi, filed the suit at the Federal High Court, Enugu, Friday.

Apart from the National Assembly, those joined as defendants in the suit number: FHC/EN/CS/28/2018 are the President, Federal Republic of Nigeria, the INEC, and the Attorney General of the Federation and Minister of Justice, AGF.

The plaintiff who is the Zonal Vice Chairman of the party in Enugu East senatorial district asked the court for an interlocutory injunction restraining President Muhammadu Buhari from giving his assent to the bill passed by the National Assembly changing the sequence of the 2019 elections, when presented to him, pending the determination of the substantive suit.

In his motion on notice brought pursuant to orders 26 and 28 of the Federal High Court (Civil Procedure) Rules 2009 and under the inherent jurisdiction of the court, Nwoga further prayed the court to restrain the NASS from overriding the President’s veto, should he decide to do so, pending the determination of the substantive suit.

He further asked for an order of interlocutory injunction restraining INEC from complying with the sequence of elections contained in the bill passed by the NASS, pending the determination of the substantive suit.
