Anti-corruption War: American lawyer writes a letter to Buhari - (Read letter)

Dear President Buhari:

When you visited the United States Institute of Peace last July, you pledged that you would be “fair, just and scrupulously follow due process and the rule of law, as enshrined in [the Nigerian] constitution” in prosecuting corruption.

Such loftiness is laudable. As the Bible instructs in Amos 5:24: “Let justice roll down like waters, and righteousness like an ever-flowing stream.”

But to be just, the law must be evenhanded. It cannot, in the manner of Russian President Vladimir Putin, be something that is given to punish your enemies and withheld to favor your friends. If so, the law becomes an instrument of injustice bearing earmarks of the wicked rather than the good.

In the United States, you declared a policy of “zero tolerance” against corruption. You solicited weapons and other assistance from the United States government based on that avowal. But were you sincere?

During your election campaign, you promised widespread amnesty, not zero tolerance. You elaborated: “Whoever that is indicted of corruption between 1999 to the time of swearing-in would be pardoned. I am going to draw a line, anybody who involved himself in corruption after I assume office, will face the music.”

After you were inaugurated, however, you disowned your statement and declared you would prosecute past ministers or other officials for corruption or fraud. And then again you immediately hedged. You were reminded of your dubious past by former Major General and President Ibrahim Badamasi Babangida, who succeeded your military dictatorship. He released this statement:

“On General Buhari, it is not in IBB’s tradition to take up issues with his colleague former President. But for the purpose of record, we are conversant with General Buhari’s so-called holier-than-thou attitude. He is a one-time Minister of Petroleum and we have good records of his tenure as minister. Secondly, he presided over the Petroleum Trust Fund, PTF, which records we also have.

“We challenge him to come out with clean hands in those two portfolios he headed. Or we will help him to expose his records of performance during those periods. Those who live in glass houses should not throw stones. General Buhari should be properly guided.”

You then swiftly backed off your zero tolerance policy because you would have been its first casualty.

You opportunistically announced that zero tolerance would be narrowed to the predecessor administration of Goodluck Jonathan because to probe further would be “a waste of time.” That conclusion seems preposterous.

In 2012, the World Bank’s ex-vice president for Africa, Oby Ezekwesili, estimated that a stupendous $400 billion in Nigerian oil revenues had been stolen or misspent since independence in 1960. The lion’s share of that corruption spans far beyond the Jonathan administration.

Your zero tolerance policy seems to come with a squint to avoid seeing culpability in your political friends.

A few examples are but the tip of the iceberg.

A Rivers State judicial commission of inquiry found that N53 billion disappeared from the Rivers State Reserve Fund under former governor Rotimi Amaechi.

Former Lagos governor and head of your campaign finance team Babatunde Fashola was accused of squandering N78 million of government money to upgrade his personal website.

The EFCC has ignored these corruption allegations, and you have given both promotions: the Ministry of Transport to Mr. Amaechi, and the Ministry of Power, Works, and Housing to Mr. Fashola.

In contrast, you have played judge, jury, and prosecutor in the newspapers to convict former PDP Petroleum Minister Diezani Alison-Madueke of corruption.
Is this evenhanded justice?

United States Supreme Court Justice Robert Jackson taught: “There is no more effective practical guaranty against arbitrary and unreasonable government than to require that the principles of law which officials would impose upon a minority must be imposed generally. Conversely, nothing opens the door to arbitrary action so effectively as to allow those officials to pick and choose only a few to whom they will apply legislation and thus to escape the political retribution that might be visited upon them if larger numbers were affected.”

To investigate or prosecute based on political affiliation or opinion also violates Articles 2 and 7 of the Universal Declaration of Human Rights. It is unworthy of a great nation like Nigeria.

Make the hallmark of your administration justice, not retribution, and you may live for the ages.

I am a United States citizen and lawyer. I have no political standing in Nigeria.

Some might argue that my speaking about the administration of justice in Nigeria bespeaks impertinence.

But you chose to visit the United States to solicit weapons and other assistance from my government–a government of the people, by the people, for the people.

The United States government represents me. What the United States government does reflects on me. I thus have an interest in addressing the actions of foreign governments that receive United States government aid.

  9. Corruption must be punished irrespective of who commits it. The fact that Mr. A is corrupt is not a reason not to punish Mr. B if he is corrupt.   29. If yours does not need shock therapy, examine Bruce's letter against American's dirty deals through their trans-national companies in African countries and globally. Again, learn more about the US before the anti-trust cases against Rockefeller, Carnegie and the likes when they held the USA at the jugular. Successive presidents before Roosevelt protected them, yet in terms of age, the US was older than Nigeria is today in their democracy. Another point is today’s successful developed nations violated human rights to achieve greatness: Britain (before Magna Carta), France (before the Napoleon Revolution); USA (before Civil Rights and slave abolition). So my dear, go back to history to better understand the present. Buhari is fighting with an arm tied to the back because of the patchwork of parties that saw him through. I am optimistic here. Follow Machiavelli’s precepts:

  35. Is anyone being prosecuted in Nigeria who did not commit the crime of corruption? The answer is most likely NO. Is Buhari going after the innocent? The answer is NO. Therefore what is the issue? Only the treasury looters appear to be upset on the country's efforts to recover their loot and send them to prison. There is no statue of limitation on corruption in Nigeria, therefore the individual can be prosecuted 500 years after the offence was committed, assuming they are still alive. Buhari in attempting to set a timeline in the pursuit of treasury looters is only looking at the resource and energy that such pursuits would require. Bruce Fein should be cheering Buhari's efforts to reign in corruption in Nigeria, instead of appearing to endorse it for whatever reason. Even in his own country, do politicians not make about-turns in some of their promises? Stay out of it, Mr. Fein, unless you have someone to protect in faraway Nigeria. From your address, your office is less than two miles from the Nigerian Embassy in Washington, D.C. Is it possible you made "friends" at the Embassy and you are now trying to help your firends out?   39. If Mr. Bruce was paid to write this letter, I think the money was well spent because what he wrote are living facts. The strongest fact being that Buhari went to the USA, and I would like to add that he also went Chatham House in the UK, to make loud promises. If PMB has forgotten the promises he made to those Oyibos, and started going back on them, someone very close to him should advice him to remember that it was based on those promises that John Kerry came to Nigeria, presided over a peace agreement that was used to force GEJ out of office for PMB to sit as President without a fight. As far as this presidency is concerned, America & Britain remains the political finger that he must NEVER bite. If he has promised them anything to get there support, he must ensure that he keeps those promises. I was not there during there closed door sessions, neither were most Nigerian who have commented here so far. Remember, the good book says, you shall reap what you sow. If Buhari has lied to America & Britain to get their support to remove GEJ, he is sowing corruption and corruption he shall reap in the short or long run. If u make a deal with the devil and think u can scam him, think again....the devil always collects. Mr. Bruce is just reminding PMB to make good the promises he made both in the open and in secret, & fulfill his own end of the deals he made so that he will not be found wanting when it is time for them to collect.   44. Sometimes, the reputation of man is a crucial factor in the assessment of the message he claims to bear.

    For example, going through internet I see the following about Mr Bruce;

    1. Has not been successful in marriage, which means, he does not really possess the temperament to lead a home. So I wonder, how he can then really understand the dynamics of leading a complexly diverse Nation like Nigeria.

    2. Fein was a top Justice Department official under the Ronald Reagan administration. He has heavily criticized every subsequent U.S. president. By this, it is normal for Mr. Bruce to write just anything that he feels personally is okay without due recourse to the dynamics and complexities that at play.

    I think we need to continue appealing to every Nigerian that has any form of legally admissible evidence against any APC people to please publish them on the internet or even make them available to Sahara Reporters or better still make them available to Mr. Bruce.

    May God complete the deliverance of Nigeria from utter backwardness in the mighty name of Jesus, Amen.

  46. Point of correction to everyone here. The truth is bitter but it will always remain the truth and stand the test of time. APC as a government has no morale because it is made up of rotten eggs and dubious character. They have display their show of shame at the national level and present in Kogi State. Nigeria should know that the world has grown past the era of patient cos people grow older by the day and things change in a more rapid momentum and dynamism. Please, allow mW to ask this question. What actual and effectual change has APC made since the assumption of office? Today unemployment rate is astronmous, fuel that was once a common commodity is not hardly bought in filling stations, our naira the worst devaluation, our economy is on the meltdown, corruption is now legalised in high places in the disguise of multiple portfolio in ministerial appointment. I wonder where as a country we head to now. The president being the minister of petroleum cannot be caution in spate of the current fuel scarcity because he lives above the law.

    Many may argue Mr. Bruce to be paid agent, but it is the truth that is said; if you doubt carry out your investigation on every point that is made. I fear Nigeria as a country will be enslaved for the next four years and probably more if care is not taken.

    Many people accuse PDP of being in government for 16 years in squandering national wealth. But we should remember it is PDP who brought the little good things we enjoy in this country. Also remember that the felt the bounties of PDP in government. I am not supporting corruption, but the money got to every nock and cranny of this country.

    Now the APC has come with it policy of fighting corruption, a tactic to distract Nigerian so the money can be siphoned to the pocket of the few. I fear Nigeria will be early enough to wake up from its dream of mirage. REMEMBER CHANGE CAN BE FOR GOPD OR BAD, AND DONT FORGET NIGERIA VOTED FOR CHANGE.
