Taraba High Court restrains action against Suntai



An high court siting in Jalingo, the Taraba State capital, has restrained the acting governor, Speaker and the state House of Assembly, from taking any further steps or actions or further doing anything in any manner or otherwise in relation to the office of the state governor of Taraba pending the outcome of the case earlier filed by Suntai.

It will be recall that Taraba State house of assembly on September 13 constituted a five man medical team to verify the health of Governor Danbaba Suntai of Taraba State who had an accident in a plane clash in 2012 near Yola in Adamawa State.



The high court presided by Justice Silas Haruna said the motion was brought in pursuant to order 10 rule 1′ 2(1) and (2) 6 and 7(1) and (2) order 8 rules 5(1) and (2) of the Taraba State high court civil procedure rules 2011 and under the inherent jurisdiction of the honorable court.

The court refused to grant an injunction to restrain the recent five man medical panel set by the state house of assembly stating that the medical panel had not been made a party to the earlier proceedings of the applicant. The judge said,“This court lacks jurisdiction to make an order against a body which had been joined as proper or necessary party. The determination of the notice was fixed for September 26, 2014.

“By the order 9 rule 5 of the rules or this court this court has powers to abridge for time doing an act. The time for entry of appearance in this suit is hereby abridged from 30 days as stipulated by the rules of court to 15days from the date of service of the originating summons on the defendant.”
