INEC withdraws Dan Abia's certificate of return

Following the declaration of the former chairperson of the House committee on information, Eseme Eyiboh, by a Federal High Court in Abuja as the candidate to represent the Eket federal constituency of Akwa Ibom at the recent House of Representatives, the Independent National Electoral Commission (INEC), on Monday withdrew the certificate of return earlier issued to Bassy Dan Abia.
Presiding judge, Abdul Kafarati, made the declaration in favour of Mr Eyiboh in his ruling. Mr Eyiboh had filed a suit asking the court to set aside the primary election, which was held in his constituency on January 28, 2011, claiming that the Peoples Democratic Party (PDP) did not conduct any election before forwarding the name of Bassy Dan Abia to the Independent National Electoral commission (INEC).
In his judgment, Mr Kafarati said the headquarters of Eket/Ibeno/Esit/Onna federal constituency was Eket and that any primary election conducted outside the headquarters was null and void and of no effect, and ruled that Mr Eyiboh who conducted his primary election at the headquarters as the right candidate.
INEC's letter with reference number INEC/LEG/CAN/1 dated June 4, which stopped Dan Abia's inauguration was signed by the commission's Secretary, Abdullahi Kaugama and sent to the Clerk of the National Assembly.
It said, "This is to request the National Assembly to discountenance the certificate of return issued with respect to the under listed constituency.
Bassy Dan Abia was issued the certificate of return upon being declared the elected candidate of the Peoples Democratic Party for Eket/Ibeno/Esit/Onna federal constituency in Akwa Ibom."
Furthermore the latter said "The Federal High Court later gave judgment against the candidature of Dan Abia. A notice for stay of execution of the judgment has been filed. The certificate of return is now invalid."
Specifically, Mr Kafarati in the judgment ordered that "the primaries purportedly held at Uyo township stadium on the January 28 and 29, 2011 at which Mr Dan Abia was purportedly elected as the candidate of the PDP for election to office as member of the House representing Eket/Ibeno/Esit/Onna federal constituency in Akwa Ibom for the 2011 general elections is hereby set aside".
