Election tribunal orders INEC to produce polls material for forensic inspection

THE National and State Assembly Election Petitions Tribunal sitting at Asaba, has ordered the Independent National Electoral Commission, INEC, to produce for forensic inspection, all polling documents used during  the just concluded National Assembly polls in Delta South Senatorial district and the Warri Federal constituency of Delta State.



The order which was sequel to a motion ex-parte  by Mr. A. Oriakhi on behalf of Mrs. Temi Harriman of the Action Congress of Nigeria, ACN and Omasan Agbajor of the Democratic Peoples Party, DPP, as petitioners, has Senator James Manager, Mr Daniel Reyenieju, PDP and Independent National Electoral Commission, INEC, as respondents.

The petitioners had asked the tribunal  for an order, directing INEC to, amongst others, produce or make available for the inspection of the applicants or their representatives, the polling documents used in election held in Delta State on April 9, 2011 to enable them  maintain their petitions challenging the results of the said election.

They also want the tribunal to direct INEC to allow them, their representatives including forensic experts unhindered access to the said polling documents  to enable them analyse or compare the finger prints and handwriting on the said documents for the purpose of using same in evidence in proof of their petitions.

The Tribunal Chairman, Justice Y.G Dakwak in a true Certified Copy endorsed by D.A. Musa ESQ, dated 03-06-2011 and signed by its Secretary ordered the INEC to comply with the prayers to enable the petitioners maintain the action against the respondents.
