Nigerian senate dares court, vows not to recall suspended Ali Ndume

The Senate has explained why it will not lift the six months suspension handed to Senator Mohammed Ali Ndume.


Ndume is representing Borno South Senatorial District at the Red Chamber of the National Assembly.

The senate, through its lawyer, Chief Mike Ozekhome, SAN, said it disagreed with the verdict of the Federal High Court, Abuja, which not only voided Ndume’s suspension from the Senate since March 30, but also directed that he should be paid all his outstanding salaries and allowances.

Consequently, it has asked the Abuja Division of the Court of Appeal to set-aside the judgment, which was delivered last Friday by Justice Babatunde Quadri.

According to the Senate, “the high court lacks the jurisdiction to entertain the suit Ndume filed to challenge his suspension.”

However, in its appeal, the Senate maintained that the plaintiff wrongly joined several causes of action in his originating summons.

It argued that, “an action for the enforcement of fundamental rights to fair hearing could only be brought against a court or a tribunal, established by law as held by the Supreme Court in several current cases, and not against committee of a legislative body.”

Besides, the appellants contended that by the provisions of sections 3 and 30 of the Legislative Houses (Powers and Privileges) Act, the high court lacked requisite jurisdiction to hear the suit of the Plaintiff.


It has, therefore, urged the appellate court to stay execution of the judgment pending hearing and determination of the appeal.

  1. Ndume,you are the next movie and APC firm tricks. There is rules that governs the activities of the National Assembly/Legislative Houses (Powers and Privileges) Act. You aired by giving a wrong information to the general public and you also make-sure a committee was set up to backup your fake stories about the leadership in the same house where you operate. Now the committee came out their reports after proper investigation knowing you lied about all you said about the leadership of the same house.
    Question 1: How they suppose to discipline you according to the Powers and Privileges Act that guilds your activities in the house???

    Question 2: How the suppose to celebrate you for force information giving to the public???

    I don't understand this our country,you are suspended for something you did wrong in the Legislative arm and you ran to the Judicial arm of government to restore you back to the house. All this shit does not work in civilized country. You will remain suspended according to the laws in the house,which has been part of Nigeria constitution. This is how things works in a democratic environment. You want us to be clapping for your wrong information against the most highest institution in our country.

  2. @Anonymous, you must be the new spokesperson for the lawbreakers. The kangaroo committee that was set up to fool people that the drop out Dino Melaye was clean Afterall, those that went to ABU knew Dino was packaged out, this man was suspended simply for his support for Magu. 2019 is around the corner, all of them would be history , Ndume inclusive.

    1. Dont deceive people,Magus issues was different from this issue. Ndume,said it clearly that cars been held by custom boss belongs to Senate president and Dino. After proper investigation is was a clear lie against his own colleges,so the act and privilege of the house fell upon him. In a joint section of the full house its was trowed open,which i watched, 98% majority of the members said eyeeees to the suspension. Dont bring Magu into this issue. Find out information very well before you make comments. Mind you i dont have any business with the Senators nor Ndume. I am a free thinker
