"Buhari has breached separation of powers" - PDP condemns arrest of judges

The Peoples Democratic Party has condemned the arrest of some judges by the operatives of the Department of State Services.



It said that the Gestapo-like raid on the homes of a number of Justices of the Supreme and the Federal High court judges was unwarranted.

In a statement by its Spokesperson, Dayo Adeyeye, in Abuja on Sunday, the PDP said, “This invasion is the latest in a series of actions taken by the President Muhammadu Buhari administration which revealed its disregard for the rule of law and its abject disdain for the principle of separation of powers.”


The party said Governor Nyesom Wike of Rivers State was assaulted by DSS operatives for insisting on that the security agents should uphold the rule of law, while the affected judges were manhandled and their workers beaten up.

According to the party, President Muhammadu Buhari’s administration is becoming fascist.

It said the slide into fascism started with the invasion of the Akwa Ibom State Government House by the DSS and the continued detention of several people despite courts orders to the contrary.

The PDP said, “This slide into fascism has included a sustained attack on the leadership of the National Assembly as President Buhari has sought to break its independence and make it a rubber stamp to suit his will.

“It is worthy to note that never in the history of our country has any President attacked the judiciary in such a manner.

“Even the late dictator, Gen. Sani Abacha, whose regime is remembered by many as the second worst regime in Nigerian history did not carry out such Gestapo-style attacks on the members of the judiciary.

“By bringing this attack to the judiciary, President Buhari has shown that he has no desire to respect the pillars of our democracy.

“He has shown his desire to kill off our democracy and convert it to an autocracy without checks and balances.”

The PDP further alleged that the government had no regard for the rule of law and does not care about court orders.

“This Government has disregarded the orders of the ECOWAS court and every other court in the land and continue to detain Sambo Dasuki illegally. They continue to detain hundreds of Nigerians without bringing them to trial and against valid court orders,” it said.

It argued that the right thing for the DSS to have done with regard to the judges accused of corruption is to “forward a petition containing any wrongdoing to the NJC along with any evidence in support thereof”.

“The path not to follow is this Gestapo-style invasion in the middle of the night that involves the use of sledgehammers to breakdown gates and front doors for DSS to gain access to the homes,” it said.

“Nigerians can no longer afford to stand aside and watch the Buhari Administration destroy the foundations of our democracy that we have built for several years.”

    THE NBA!!!

    In 2015, a total of 34 Ghanaian judges, including 22 lower court and 12 high Court judges, were caught on video asking for bribe. This triggered widespread anger across Ghana, and no professional lawyers' body declared a phantom state of emergency or issued some puerile threats as the NBA has done after some Nigerian judges, including those of the Supreme Court, were caught with huge sums of money in different currencies.

    Before long, 20 of the 22 lower court judges were sent packing. That's Ghana!

    Now back to Nigeria. If Supreme Court Justices could be involved in this cashgate nonsense, what will happen to the judges of the lower courts?

    And why would a self-respecting body not wait for the full details to emerge before issuing threats? Are judges above the law?

    The judges in whose residences huge sums of money were found have not been declared guilty. They will have their day in court. But one thing is sure. They were found in possession of monies they cannot account for. That in itself is enough reason for anger and condemnation. No NBA can brow beat Nigerians. No way!

  2. PDP is a promoter and supporter of corruption. in short, architect if corruption. Are Judges untouchable? if no, how then do u want them to be checkmated. These Judges are no longer upright. They told us that Ibori case file was eaten by termite. What were those hard and local currencies doing in their homes. Do they run banks in their homes? Forget politics and let's face reality.

  3. What do you expect from an illeterate soldier who joined the army when only dropouts were sought after! This Man has been desperate for power all his miserable life and as such will eventually abuse it. I feel sorry for the Southwest and South south and South east because it seems to us that no Judge from the North is corrupt. The truth be told Nigeria deserves all that is happening now. Thanks to the Southwest that has sold her future to slavery.

    2. You are emotionally unstable. You need help just like your patrons. Why get abusive over a comment you do not agree with? This is the kind of crude method that is being employed by this government that we do not agree with.Please,prove that the allegations that those huge amounts were fond in the Judges custody,and show and present such evidences. The gestapo style in the investigation is not right and should be condemned. I am not making a case for corrupt judges and I can not support a government that abuses its powers and undermines the rule of law. This is not a military rule and in any case your rights will eventually be violated.

  4. So Judges are corrupt and therefore should be dealt with in a ruthless manner. What happened to the Dogara and Jibrin revelations? What happened to the forgery case dropped against Saraki and Ekweremadu. God is watching..

  5. Just passing by.... just want to say nobody is above the law. Sometimes we have to break the law to achieve what we want. If proper procedures were taken. Those money would not have been recovered. The judges would have hidden the money and no evidence to prove.judges are smart . I think it's the best way to get at them.

    1. Yes, I agree nobody I above the law, but due process must be followed in a democracy. The DSS has no right to arrest judges that have not been tried by the National Judicial Commission. It is the NJC that can recommend prosecution after finding the judges guilty.
